1. Who you are contracting with

These Terms & Conditions ("Terms") govern your use of the Edify digital learning platform (the "Service") operated by Edify Eswatini ("Edify", "we", "us", "our"). By creating an account, purchasing a toolkit, or otherwise using the Service, you agree to these Terms.

2. The service

Edify provides downloadable, self-paced educational resources, templates, and career-preparation toolkits. The Service is informational and educational only. We do not guarantee employment, income, visa, or residency outcomes.

3. Accounts

You must provide accurate information when registering, keep your credentials confidential, and are responsible for activity under your account. You confirm you have authority to enter into these Terms (or are of legal age in your jurisdiction).

4. Acceptable use

You agree not to misuse the Service. In particular, you must not:

  • Use the Service for unlawful, fraudulent, or abusive purposes.
  • Infringe intellectual property or other rights of Edify or any third party.
  • Resell, redistribute, or publicly share purchased toolkits, files, or templates.
  • Attempt to probe, scan, scrape, reverse engineer, or interfere with the security or integrity of the Service.
  • Upload or transmit malware or harmful code.

5. Intellectual property

All content, software, branding, and materials made available through the Service are owned by Edify or its licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to access and use purchased toolkits for your own personal or professional development. All other rights are reserved.

6. Payments and billing — Paddle as Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, applicable taxes, invoicing, and cancellations are governed by Paddle's Buyer Terms. Prices are shown on the Service and may include taxes calculated by Paddle based on your location.

Refunds are handled in accordance with our Refund Policy.

7. Delivery and access

Once payment is confirmed by Paddle, the purchased toolkit is unlocked in your account and available to download from your library. Access is granted on a lifetime basis for the specific toolkit purchased, subject to these Terms.

8. Service level and availability

We work hard to keep the Service available and useful, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue parts of the Service at any time.

9. Warranties and disclaimers

To the fullest extent permitted by law, the Service and all content are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the fullest extent permitted by law, Edify shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our aggregate liability arising out of or relating to the Service shall not exceed the amounts you paid to Paddle for the relevant toolkit in the 12 months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law (such as fraud or personal injury caused by negligence).

11. Indemnity

You agree to indemnify Edify against claims, losses, and reasonable costs arising from your breach of these Terms, your misuse of the Service, or your violation of applicable law or third-party rights.

12. Suspension and termination

We may suspend or terminate your access if you materially breach these Terms, fail to pay, present a security or fraud risk, or repeatedly violate our policies. You may stop using the Service at any time. Provisions that by their nature should survive termination will do so.

13. Changes to the terms

We may update these Terms from time to time. Material changes will be communicated through the platform or by email. Continued use of the Service after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the Kingdom of Eswatini, without regard to its conflict-of-laws rules. The courts of Eswatini will have non-exclusive jurisdiction over disputes, except where mandatory consumer-protection laws give you the right to bring a claim in the courts of your country of residence.
